Heath Insurance Portability and Accountability Act of 1996 (HIPAA) was a privacy protocol put in place to protect patient’s rights against releasing any personal or medical information about them without their consent. Generally, at each initial doctors appointment you fill out a set of forms and within that set there is a HIPAA form to complete allowing you to list specific individuals who you will allow to receive information regarding you. At any time, you can add or remove anyone from this form but it is illegal to give any information out if they are not on the most current list. There are certain instances where HIPAA can be broken for the safety of the patient of those around them. “The major exception to the need for specific authorization for the release of PHI is that medical care providers may release information to other providers and entities who are participating in the patient’s care, and to business that provide services for those providers” (Richards, 2009, pp. 1). There is no direct authorization needed for physicians to consult back and forth as well as those physicians communicating back and forth with insurance companies relating to the patient for billing purposes. Reporting incidents like child abuse, diseases, violent injuries, and suicidal thoughts and behavior also does not need authorization to expose. These are life threatening conditions and must be reported in order to save someones life. It is imperative that physicians report these cases because although they have a duty to privacy to their patient when physical harm or death is involved that trumps any other confidentiality. Lastly, a patients information can be revealed if they are trying to identify a patient. If someone shows up with no identification and unable to say who they are they can use their medical history and records to find out who they are.ReferencesRichards, E. (2009, April 19).
