Case Scenario kJoker’s Revenge Brad Chumpster was out drinking with his girlfriend Shawna Tippster on a warm summer night in Anchorage, Alaska. The time was about 11 p.m., but it was still light outside. They were at the Chilcoot Charlie’s lounge, when an argument began over whether Shawna’s dress was too revealing, and whether Shawna had been flirting with the waiter. They left and the argument escalated to yelling and shoving as they walked down the public sidewalk outside. It was a Friday night; there were lots of people out enjoying the extended daylight. A police car was parked at the end of the block, and two uniformed, Anchorage police officers, Harvey Jones and Andrea Ly were on the sidewalk, breaking up a fight between two drunken fishermen on shore leave. As Brad and Shawna walked past the police car arguing, a German Shepherd police canine (K9) officer within the compartmentalized back section of the squad car, Joker, began to bark loudly and lunge at the window towards Brad. Brad’s girlfriend was very startled; she jumped backwards and fell down, breaking a stiletto heel. The two men fighting just a few feet away continued to yell loudly, and the police continued to try and break up their altercation. Brad reached down to help Shawna, who chose to kick his shin instead of taking his hand. Brad staggered backwards, and leaned heavily into the parked police car. The canine inside began to snarl and bark even more wildly, throwing itself at the window, and one of the police officers turned towards Brad and Shawna and yelled, “What do you think you’re doing!? Get the hell away from there unless you want to go to jail!” Shawna yelled back, “He’s drunk! He assaulted me! Now he’s trying to f___ up your dog!” Brad turned and looked into the police car at Joker, who was now pawing wildly at the back window, barking and snarling non-stop. “Right!” Brad yelled, “Woof woof! Rip my throat out! It’s all my fault! Everything is my fault! You’re almost as bad as Shawna!” And he began to wave his arms around and slap at the windows of the car. At the same time, the dog’s handler, Harvey Jones, yelled out in pain as one of the drunken men took a swing at him. The dog inside the car began to shred the upholstery and seatbelt with its teeth, in an apparent effort to get out of the car. Brad began to laugh and point at the dog. He picked up Shawna’s broken stiletto heel and tapped it on the roof of the police car and started waving his arms, and making barking noises back at the dog, and singing the words to the pop song “Going Solo.” In its frenzy to get at Brad, the dog, Joker, caused over $2,000.00 of damage to the interior of the police vehicle. According to his handler Joker also lost a tooth (which was never produced in evidence) and was “stressed and traumatized.” Shawna walked away, and Officer Harvey arrested Brad for the crime of Harming a Police Dog. Brad was released on his personal recognizance (without bail) later that night from the station, and was given a court date to appear for an arraignment. Brad wants to know whether there really is such a crime in Alaska, and what kind of sentence might be involved. He is not convinced he has committed a crime, although he describes himself as acting stupid and his memory of the night is spotty. He is wondering if he could fight the case at trial, or of a lawyer could make some sort of pretrial argument to “make the case go away.” He is also concerned whether he might be ordered to pay for the damage to the police car, if he admits any wrongdoing. Brad said, “How could I harm that dog when it was inside a car? I never touched it! I don’t hurt animals! I thought that animal cruelty laws were about stuff like hitting, kicking, starving, beating, or poisoning dogs — physical stuff like that! How could anyone know they are committing a crime by making faces or laughing and singing? Isn’t this like saying I assaulted someone when they were behind a window watching me? Do they have a dog shrink who is going to testify that I gave it PTSD? It was probably just upset that that cop was taking a beating from that drunken dude.”
