Using Blossom’s website, on May 5th, Louise purchased $50,000 worth of live wedding flowers using her credit card, from her home in Dallas, Texas. She requested the flowers to be shipped and delivered by May 15th to a hotel in Indiana, the site of the wedding. The flowers arrived onMay 14th, the day before the wedding, but Louise claimed they were withered and unusable.
Louise sued Blossom in a Texas state court to recover her $50,000. Ross, on behalf of Blossom, filed a motion to dismiss, claiming that the Texas court lacks jurisdiction.
