A sole proprietorship is the easiest way to start up a company. That is because there is “No formal action is required to form a sole proprietorship, other than obtaining the licenses and permits necessary to engage in your type of business, according to the laws of the state your business is in.” (Stone n.d) With a sole proprietorship there is not a legal distinction between you and your company.
To own a company as a Limited Liability Company or LLC the owner must first file all of the necessary legal documents with the state’s office. Once that is done the LLC will now be a separate entity from yourself. The IRS does not recognize an LLC as a legal entity for tax purposes. This means they have the option to file as a sole proprietorship or as a corporation.
A corporation and an LLC are similar in the process in which you go about to establish them. However, with a corporation it is state law that you will need to establish a set of bylaws, board of directors, officers, and keeping an annual record book of important business decisions and meetings. There is also the requirement of having to file annual and/or biannual reports for the state for any updated corporate information and paying any filing fees.
I do believe that a business should have the same Direst Amendment rights as an individual. In this scenario I believe there was nothing wrong with what the film did. Regardless of whether it is a company or an individual they should hold the same rights. All in all that’s all the election came down to be anyway. Both parties claiming the other is unfit for office.

A corporation is a complex arrangement with a group of owners, called shareholders, who vote for officers, or management, to run the company. This management would make all decisions for the business. Also, they would have to sign a formal written document called articles of incorporation. A sole proprietorship is one individual who owns the entire company and makes all the decisions. There are no articles needed to sign. A limited liability company is ran like partnership but with the benefits of a corporation. There is a formal written paper called the articles of organization that needs to be signed. A partnership is when two people, can be more, join together and own a business and all owners help make decisions. There is no need for any articles, but a contract or agreement is usually drawn up and signed.

Reading the article Citizens United v. Federal Election Commission, I believe that businesses should not have the same rights of the first amendment as individuals. If an individual of the business wishes to speak, that is his or her right. But a business is not a person, it is a contract binding people to one another. In the article, it talked about how these corporations were going to make a movie about Hilary Clinton and why she should not be president. This would be a violation of the first amendment rights if the businesses were a human being. But since it is a corporation it is not a human being. Also, the fact that the corporations and unions are not allowed to directly contribute to the candidate. So, I believe that a business should not have the same first amendment rights as people, but if the owner want to say something and not name his company, would be fine.
